I was in a car accident and ended up having to have back surgery the other guys insurance really sucked bad?

my fiancee has excellent insurance would common law be considered when it coming to being able to sue for his insurance since the other guys insurance sucks are and i in a bad situation my insurance sucks too, but would common law play a part in nys or not please someone let me know wht my options are thanks...
